TERMS AND CONDITIONS OF CONTRACT FOR WEDDING PHOTOGRAPHY SERVICES
In the following terms & conditions “the photographer” will indicate Diven Laxman or any agent/employee of Ikonic Media Solutions Photography. “The customer( s)” will be those persons specified as bride and groom in the wedding event booking. It is agreed that the following terms set out the total agreement made in between the celebrations and that no variation or modification of this contract shall work unless concurred by both parties in writing.
Booking Fee/ Deposit Payments
A non-refundable reservation charge of ₤ 250 along with complete approval of the terms as published on the professional photographer’s website secures the time and services of the Photographer for the wedding event and is transferable or non-refundable in case of cancellation, it being the predetermined loss suffered by the photographer due to cancellation. When determining the last balance due, the reserving fee will be deducted from the expense of the customer’s picked plan. Payment in full of the staying balance will be due 12 weeks before the big day. Weddings that are postponed to a later date will retain the charge as long as the photographer can re-schedule for the new date and time.
The details of the wedding arrangements are to be agreed ahead of time in composing (email is acceptable). The Client will inform the Photographer of any changes to these details in writing. The Photographer/s can not be held liable for delays or disturbance in their shipment of the service till any modifications are received, and acknowledged in writing.
The Client may cancel this agreement at any time by providing composed notice to The Photographer/s however in doing so will forfeit any amount paid by a client. Cancellation less than 12 weeks before the wedding will result in the payment in full becoming due. All cancellations should be in writing.
The customer( s) thus allow( s) the photographer( s) to display any photo covered by this agreement and to normally promote business in marketing, instagram, youtube, twitter and facebook, tumblr, brochures, publication short articles, websites, sample albums and prints, place and other vendor samples, and other such material, providing that the images utilized are utilized lawfully and without damage to the client( s). This list is not extensive.
The professional photographer grants the customer( s) approval to make copies of the images under the following conditions: The images taken by the photographer are for individual use by the client and their friends or household; offering the photographs is not enabled without consent from the photographer. The Photographer has unrestricted use of these images and can utilize them completely or in part in any publication (industrial or otherwise), portfolio or public display with any retouching or modification without constraint. The customer( s) thus designates the photographer the irreversible and unrestricted right to utilize and release photographs of the customer( s) or in which the client( s) may be consisted of, for editorial, trade, marketing, educational and any other function and in any way and medium; to modify the very same without constraint; and to copyright the exact same without constraint.
All image sizes are small. Force Majeure or Act of God
The due performance of this contract undergoes alteration or cancellation by either party owing to any cause beyond their control. Although all devices is inspected regularly and affordable steps are taken to ensure backup equipment is available, the professional photographer will not be accountable for photos that are not produced due to technical failure.
In the unlikely occasion of the Photographer being unable to attend your wedding, as much notice as is possible would be provided and we book the right to select another photographer to attend your wedding event on our behalf to carry out the wedding photography to his/her finest ability. And if this is difficult we will do all we can to a reasonable amount to help you source another professional photographer i.e. by offering a list of other expert photographers in the location.
Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other situation the liability of one celebration to the other shall be restricted to the overall value of the agreement. Neither party will be liable for substantial or indirect loss.
Any directions provided to customers, their guests or workers throughout a photographic shoot are considered to be at said individuals own threat. The professional photographer can not be held responsible for any personal accidents during a photographic shoot.
This arrangement shall be governed in accordance with the laws of England and Wales.
